TAR grants Polis appeal for Italian Red Cross employees

“The affair,” explain the lawyers involved, Francesco Paolo Bello, Andrea Di Comite and Saverio Nitti, “originates from a 2008 inspection of the State General Accounting Office on budgets, following which the Italian Red Cross proceeded to the legal and economic reconstruction of the careers with respect to all its non-commissioned officers (marshals), who in the period 1994/1995 had benefited from advancements in rank, illegally ordering deductions from their paychecks starting with the December 2014 payroll.

The Regional Administrative Court found “that it did not agree, on a first summary examination and subject to further study on the merits, with the actions of the Red Cross, which, after noting the offsetting of receivables from undue payments and debts for contractual arrears to be paid to the plaintiffs, already committed for this purpose in the 2013 budget, removed the effects by ordering the cancellation of the residual liabilities related to said contractual arrears.”
