The Court of Cassation, last February, accepted several grounds of appeal of the defense, annulling the sentence of the Court of Assizes of Appeal of Bari with which the sentence of first instance conviction against Gaetano Scalese for the murder of Pietro Capone, which took place on March 10, 2014 in Gravina in Puglia, had been confirmed.
Last Tuesday, July 8, before a different section of the Court of Assizes of Appeal of Bari, the first hearing of the new trial against the defendant, a seventy-three-year-old building contractor, was held, assisted by Andrea Di Comite – founding partner of Polis Avvocati, assisted by Gaja Martinelli and Alessandro Lorusso – and Saverio Verna.
In particular, in the face of the joint request of the defense and the Attorney General, the Territorial Court, in compliance with the provisions of the Supreme Court, has ordered an anthropometric and ballistic expert investigation, postponing it to next September 18 for the assignment of the assignment.
At the same time, the request for mitigation of the precautionary measure of house arrest was also accepted, replacing it with the obligation to sign and stay.
